A man who found his P45 in his pay envelope following a disagreement with his employer has been awarded €20,000 under the Unfair Dismissals Act.

Seán Norris, Northfields, Clonmel, Co Tipperary, took a case for unfair dismissal against Kenneth Harris, managing director of H and N Engineering, Rathgormick, Co Waterford, and also against the company.

In June 2009, as a result of a disagreement with his employer, the claimant asked for his P45 and the employer said he would give it to him if he wanted it.

In its determination, the Employment Appeals Tribunal said it seemed that the employee requested his P45 out of frustration but had not intended to resign.

There was no appearance on behalf of the respondents.
