The case of two men charged in relation to the shooting of a Dublin publican, Charlie Chawke, has been adjourned until May 3rd after new indictments were lodged in Dublin Circuit Criminal Court.

Judge Desmond Hogan had warned Patrick McCarthy SC, representing the Director of Public Prosecutions, earlier this week that if the indictment was not presented by yesterday, he would strike out the charges.

Frank Ward (51) of Knockmore Avenue, Tallaght, and Larry Cummins (54) of Summerhill Parade, Dublin, are charged in relation to the shooting and robbery of Mr Chawke, at his public house, the Goat, Goatstown, on October 6th, 2003.

Pauline Walley (with Mr McCarthy) for the DPP, told Judge Hogan that an indictment had now been served on both accused.

Patrick MacEntee SC, for Mr Cummins, told Judge Hogan that judicial review proceedings by both accused were scheduled to be heard on April 26th and asked for a remand of the case until May 3rd.

Barrister Liz Walsh, for Mr Ward, agreed to the May 3rd adjournment.

Judge Hogan also agreed to a request by Mr MacEntee for leave to apply to the court again before May 3rd if necessary "for reasons to do with my client's health".

Mr Chawke was shot in the leg when confronted by two armed men as he left his pub to bring takings to the bank. His leg had to be amputated.
