Defence lawyers for the 78-year-old Dingle fisherman charged with murder in the Isle of Man are expected to receive the prosecution papers today, prior to his appearance in court tomorrow.

However, although the committal papers are expected to be ready today, the case is unlikely to go ahead tomorrow as the defence will need time to examine them.

Irish consular officials are expected to be present in court, along with members of Mr Benny Moore's family, who have been seeking to have him bailed back to Ireland while awaiting trial.

Mr Richard Benedict (Benny) Moore has been on the island since last October, when he was charged with the murder of Ms Maureen Fox.

He was held in custody for almost two months before being released on bail, but without permission to leave the island despite an extradition agreement between it and Ireland.

He has been staying in a hostel, on condition of observing a curfew and signing on regularly in the local police station.

Ms Fox died following an evening spent with Mr Moore. He has been a regular visitor to the island, and travelled there for the October bank holiday weekend (by ferry, not by plane as reported by a Sunday newspaper yesterday).

He met Ms Fox in his hotel and, after drinking in the bar, they went to his room. She was sick during the night and he called an ambulance. She died on her way to hospital. Initial reports stated that she had choked on her vomit.

A spokeswoman for the family, Mrs Katherine Moore, told The Irish Times yesterday: "We are confident that the judicial process will in time find our father innocent of contributing in any way to Ms Fox's death."
