Gilligan asset hearing put back because of affidavits

THE CASE in which Mrs Geraldine Gilligan is trying to stop the Criminal Assets Bureau disposing of property seized at her premises last week was put back until tomorrow by the High Court yesterday.

Last Friday Mrs Gilligan, wife of Mr John Gilligan, who is detained on drug trafficking charges in England, was granted a temporary injunction preventing the CAB disposing of her property.

Yesterday the President of the High Court, Mr Justice Costello, granted an adjournment until tomorrow to allow time for the sides to consider affidavits.

Mrs Gilligan, of Mucklon, Enfield, Co Kildare, told the court in an affidavit on Friday she had been legally separated from her husband since July 1995. She was owner and proprietor of an equestrian centre at Jessbrook, Enfield. She had been in business there since January 1995 in that capacity. She lived in a house nearby.

Mrs Gilligan added that about August 6th last she received an assessment of income tax for the year 1995/96 for £1.6 million.

Mr Adrian Hardiman SC, for Mrs Gilligan, said yesterday he had not had enough time to respond to affidavits from the defence.

Both sides agreed it was an urgent matter as it related to the seizure of goods.

Mr Hardiman added that both he and Mr Richard Nesbitt SC, for the CAB, wanted the matter to be heard tomorrow.

Mr Nesbitt said he was ready to go on. He had instructions for an early hearing.

Mr Justice Costello adjourned the case until tomorrow. He said that whether the case got on depended on the availability of judges on the day.
