A couple have been awarded some €310,000 damages by the High Court arising from defects in the construction of their home.

A couple have been awarded some €310,000 damages by the High Court arising from defects in the construction of their home.

Graham and Sharon Mussett’s home at Crofton Lodge, Crofton Park, Ballina, Mayo, had multiple defects, including a geothermal heating system which never worked properly and a substandard effluent treatment system which resulted in the garden becoming waterlogged with semi-treated waste-water, the court noted.

The couple sued builder Alan Piper, trading as Alan Piper Developments, Ballina, over the defects and engineer James Maloney, of James Maloney and Associates, also Ballina, over alleged negligent mis-statement in the certificate of compliance with building regulations relating to the house.

The defendants denied the claims.
