Ryanair has been granted an interlocutory injunction by the High Court restraining Kerry Airport plc and Kerry Holidays Ltd from levying on its passengers a £5 airport development fee on outbound flights.
Mr Bill Shipsey SC, counsel for Ryanair, told Mr Justice O'Sullivan yesterday the fee was in breach of the terms of agreement under which Ryanair provided flights from Kerry Airport to London's Stansted Airport.
Mr Donal O'Donnel SC, for Kerry Airport, asked the court to facilitate consideration of an appeal to the Supreme Court. Mr Justice O'Sullivan said the fee could be charged by the airport authorities until then, and in the event of no appeal having been made to the Supreme Court by tomorrow night for an extension of the stay, the High Court injunction would come into being.
