A jury has been told that a 13year-old Co Waterford girl had a baby about nine months after she was allegedly raped by her 69-year-old neighbour.

A midwife and general nurse from the hospital where the girl gave birth in April 1998 told the Central Criminal Court that the baby was healthy and had been carried to full term.

The jury also heard that the accused man told gardai it was not possible for him to father children because he was sterile as a result of mumps.

He has pleaded not guilty to raping the girl in a Waterford village on a date unknown in or about July 1997.

Sgt James Flannagan told Mr Michael Durack SC, prosecuting, that when he interviewed the accused after he was arrested in January 1998 he said he had been tested by a gynaecologist in the 1950s after he contracted mumps and was found to be sterile.

Sgt Flannagan agreed with Mr Brendan Grogan SC, defending, that the accused had willingly given a blood sample to gardai and that no blue movies had been found in his house, as the girl had alleged.

Gardai did not find the O'Neill tracksuit bottoms which she had alleged he was wearing that day.

Earlier she had agreed with Mr Grogan, in cross-examination, that she lied to her family, friends and gardai about the circumstances of her pregnancy when it was first discovered in September 1997.

She agreed that she first told her mother and gardai that she had been raped by a boy in England around May 1997. She agreed that this story included a detailed description of the boy's attire, including the colour of his underwear.

Pressed by Mr Grogan, she said she did not think about the fact that this might lead to an investigation in London and the possible incrimination of an innocent person.

The hearing continues before Mr Justice Smith and a jury.
