A man who claims he was seriously assaulted while attending a U2 concert at the RDS, Dublin, more than 10 years ago has taken a High Court action for damages.

Mr Gerard Mullen (32), a technical stores attendant at Trinity College, Dublin, with an address at Moorefield, Clondalkin, Co Dublin, is suing Mr Derek Tierney, a security guard; the RDS; Principle Management Ltd, a management company for U2; Aitken Promotions Ltd, concert promoters; Ireland and the Attorney General.

Mr Mullen claims that at about 9 p.m. on August 27th, 1993, he was unlawfully seized by Mr Tierney and agents of the second, third and fourth defendant, carried to another portion of the premises, and thrown on the ground, sustaining injuries.

He also alleges he was unlawfully arrested, handcuffed and sat upon by a garda. Later, the garda released Mr Mullen from detention, and conveyed or had him conveyed to hospital.

He was admitted to St Vincent's Hospital, and later discharged. The next day, he claims, he felt weak and dizzy, and went to St James's Hospital. He then attended his GP, and had further hospital treatment.

The defendants deny the allegations. The hearing, before Mr Justice Herbert, continues on Tuesday.
