A Corkman from whom the Criminal Assets Bureau is seeking judgment for more than £3 million for alleged unpaid taxes will be in the Supreme Court today.

He is to ask the court to overturn a High Court decision to proceed with his judicial review challenge to the CAB's application.

In the judicial review action, Mr Patrick McSweeney, of Fairwinds, Waterfall Road, Bishopstown, is seeking to quash a 1995 Revenue tax assessment against him for £1.19 million.

Mr McSweeney claims he is entitled to counsel and solicitor of his choice for the judicial review hearing but cannot do this unless the court varies an order freezing his assets so that he can pay them. Yesterday, after two days of legal submissions on whether to proceed with the judicial review challenge, Mr Justice O'Sullivan said he would hear those proceedings this afternoon unless the Supreme Court ruled otherwise.

The CAB application relates to alleged unpaid taxes and interest for the years ending April 5th, 1992, 1993, 1994 and 1996.

The judge said he would also hear an application by counsel for Mr McSweeney to vary or discharge a court order freezing his assets.
