A man appeared in Banbridge Magistrates Court yesterday charged with killing a British soldier at a security checkpoint in south Armagh in June.

Mr Patrick David Belton (36), from Edward Street, Newry, was charged with causing the death by dangerous driving of Cpl Gary Fenton.

Cpl Fenton (29), married with a four-year-old daughter, died when he was struck by a petrol tanker on the Castleblayney Road, Crossmaglen, on June 22nd. The court heard that Mr Belton had voluntarily surrendered to police at Newry RUC station on Wednesday. Mr Rory McShane, for the defendant, applied for bail for Mr Belton on the grounds that he required further medical treatment for gunshot wounds incurred during the incident.

Police were opposed to bail, fearing that Mr Belton, originally from the Republic, would fail to appear for any future court date.

The resident magistrate, Mr Paul Copeland, granted bail of £5,000 with two independent sureties of £8,000 each.

Mr Belton was remanded on bail to appear at Newry Magistrates Court on August 19th.
