High Court order halts rail signalling inquiry

The Joint Oireachtas sub-committee inquiry into cost overruns in a CIÉ signalling system has been halted by a High Court order.

The wife of the former CIÉ chief executive, Mr Michael McDonnell who died on April 9th this year, submitted an affidavit to Mr Justice Kelly stating that she and her family have a direct interest in protecting the good name and reputation of her late husband.

Mrs Noreen McDonnell, Terenure Road West, Dublin 6, added that questions relating directly to her late husband have already been asked of witnesses by the members of the inquiry.

She said that she was concerned that the manner in which the inquiry is being conducted could effect the good name and reputation of her husband, herself and her family.

Mrs McDonnell also voiced concern at the cost of providing legal representation at the inquiry. She said she has a right to fair representation said as the initiating party the State should pay these costs.

Mr Justice Kelly granted leave for judicial review proceedings and issued a temporary order preventing the inquiry from continuing its hearings.

The Oireachtas sub-committee intends to apply to have the temporary stay lifted and is hopeful that this application will be heard tomorrow.

If the matter goes to full hearing, it is likely the case will be heard in the High Court on October 16th.
