A young boy with cerebral palsy has brought a High Court action through his mother for damages over injuries allegedly suffered as a result of alleged negligence in the circumstances of his birth at the Coombe Hospital in Dublin.

The hospital denies negligence and, while admitting the child has cerebral palsy, contends he is doing so well he cannot have suffered such severe injuries as alleged.

Alex Kelly is suing the hospital through his mother Nicola Kelly, Cole Park Drive, Ballyfermot, Dublin, arising from the circumstances of his birth there on April 6th, 2004.

Opening the case yesterday, Denis McCullough SC told Justice Iarfhlaith O Neill it was a medical negligence action, and all the issues involved were contested by the hospital.
