A man charged with sexually assaulting a teenage girl has brought High Court proceedings to stop the HSE conducting an investigation arising from the complaints against him.
The man, in his mid-30s, is due before the Circuit Criminal Court on a charge of sexually assaulting a teenage girl who had passed out after drinking alcohol.
In his High Court judicial review proceedings, the man claims the HSE has no jurisdiction under section 3 of the Child Care Act 1991 to carry out an investigation or make a determination in relation to him.
He wants orders preventing the HSE proceeding to a determination of the veracity of the charge against him pending his trial and prohibiting the HSE from disseminating any determination concerning the veracity of the charge to a third party.
