A BANK is seeking €8

A BANK is seeking €8.4 million summary judgment orders against a Co Donegal businessman and property developer on foot of personal guarantees provided by him over loans.

The action by Bank of Scotland (Ireland) Ltd (BoSI) against Charles (otherwise Charlie) Fergus, Ceol na Mara, Tullan Strand, Bundoran, Co Donegal, was admitted to the Commercial Court yesterday by Ms Justice Mary Finlay Geoghegan.

Jarlath Ryan, for Bank of Scotland (Ireland), said Mr Fergus was not opposing the transfer.

Counsel for Mr Fergus said he had no instructions yet as to a defence to the case and needed time to consider the papers.

Ms Justice Finlay Geoghegan adjourned the proceedings to April 19th.

The bank’s claim arises under personal guarantees which were allegedly executed by Mr Fergus from 2004 to 2008 over liabilities to Bank of Scotland (Ireland) of Fergus Haynes Developments Ltd.

The bank moved on foot of the guarantee in December 2009 after the company failed in September 2008 to repay €7.7 million then due and owing

It claims that €8.47 million was due and owing from Mr Fergus as of March 15th.
