The High Court has directed that the State must pay the costs - estimated at up to €2 million - of the court proceedings relating to three frozen embryos earlier this month.

The case relates to three embryos produced during IVF treatment undertaken by a married couple in the Sims clinic in Dublin some years ago.

The wife had sought to have the three embryos implanted in her against the wishes of her estranged husband.

The High Court rejected her bid.

Mr Justice Brian McGovern found last week the embryos are not "unborn" within the meaning of Article 40.3.3 of the Constitution - the right to life amendment inserted after a 1983 referendum - and therefore do not have constitutional protection for the unborn as set out in that amendment.
