The High Court has granted leave to challenge a decision of the Waterford county manager to continue to search for a landfill site in west Co Waterford.
The judicial review challenge is being taken by Ms Ann Ho gan, of Barranalira, Dungarvan, a member of the Lickey Concern Group, which has objected to the location of a landfill waste-disposal facility at Garrynagree, Co Waterford.
Mr Gerard Hogan SC, for Ms Hogan, told Mr Justice McKechnie yesterday that while no decision had been taken to locate a site at Garrynagree, his argument was that the county manager was acting contrary to the Waterford County Waste Management Plan, 1997-2002, in continuing a selection process for a landfill site in the area.
The waste plan provides for a new landfill site but specifically precludes such a site in the west of the county, it was stated. Mr Hogan said Waterford County Council passed a resolution in June directing the manager to cease searching for a landfill site in that area.
The council also defeated a resolution which proposed that consultants appointed by the council to complete the waste strategy be allowed to finalise their report and that no decision would be taken pending completion of an environmental impact statement.
Mr Justice McKechnie said he would grant leave to seek an order quashing the county manager's decision of November 24th to continue a site-selection process for a landfill site in Garrynagree, and compelling him to act in accordance with the waste-management plan.
