The make-up of the new Parades Commission in Northern Ireland is to be challenged in the High Judicial review of appointees to Parades Commission Court in Belfast.

A member of the Garvaghy Road Residents Coalition in Portadown has lodged papers seeking a judicial review of the six people appointed by the Northern Secretary, Mr Peter Mandelson.

Ms Evelyn White, of Churchhill Gardens, Portadown, claimed the appointment of Mr John Cousins, Rev Roy Magee, Mr Billy Martin, Mr Peter Osborne, Sir John Pringle and Mr Peter Quinn was unlawful and therefore invalid.

Ms White, a grandmother who has lived in the Garvaghey Road area for 28 years, claimed in papers lodged in court that Mr Mandelson ignored or failed to comply with the statutory requirement to ensure the members were representative of the community.

"As a result there are no women members, two Catholic members and one nationalist member," it was stated.

It was claimed this amounted to discrimination on the grounds of political opinion and the appointments were unreasonable, unfair and perverse.

It was also argued the Secretary of State's decision was reviewable on the grounds of illegality, irrationality and procedural impropriety.

The solicitor acting for Ms White, Ms Padraigin Drinan, said: "We are not blaming the people who were appointed. We are saying the procedure was wrong and the end result was therefore wrong.

"We are blaming the Secretary of State for not following the proper procedure and thereby ending up with an unbalanced commission."

Before the case can proceed, leave has to be granted by Mr Justice Kerr.

Ms Drinan said she hoped leave would be granted early next week..
