A High Court Judge has recused himself from ruling whether evidence from Catherine Nevin's murder trial can be used in a civil action aimed at stopping her from inheriting any of her late husband's estate.

Earlier this week Mr Justice Roderick Murphy reserved judgment on an application by siblings of the late Tom Nevin for an order permitting them to use evidence from the murder trial, and of her conviction, in their action aimed at fully disinheriting her and seeking damages for wrongful death. Lawyers for Mrs Nevin (61), who denies involvement in the murder, argued the evidence was not admissible.

Yesterday, Mrs Nevin's lawyers said, following discussion with their client, she wished the judge to recuse himself from the action on grounds that, in 2001, he was a member of a three judge Court of Criminal Appeal that determined an aspect of her appeal against conviction.
