THE Supreme Court yesterday fixed June 17th for the hearing of an appeal by the Dunnes Stores (chief executive, Mrs Margaret Heffernan, against a High Court order removing her as executrix of her late sister's will.

Last Monday Mr Justice Smyth of the High Court appointed a Dublin accountant, Mr Garrett Wren, to administer the estate of the late Ms Therese Dunne, saying he believed the continuation of Mrs Heffernan as executrix would be detrimental to the welfare of the estate.

Mr Justice Smyth gave judgment in proceedings brought by Mr Ben Dunne, a brother of Mrs Heffernan.

Mrs Heffernan had been named as executrix by the late Ms Dunne in a will which was confined to 265 preference shares in the Dunnes holding company. The remainder of her estate, with a net value of £22.5 million, is governed by the intestacy laws.

The Chief Justice, Mr Justice Hamilton, yesterday put a stay on the High Court order until the hearing of the appeal.
