A former Garda sergeant has been granted leave by the High Court to challenge a decision of his superiors forcing him to resign after 24 years service for alleged discreditable conduct.

Mr Stephen McCann, counsel for Mr Michael Deasy, of Roselawn Close, Clonsilla, Co Dublin, told Mr Justice Moriarty the decision of the Garda Disciplinary Board was tantamount to depriving his client of his livelihood and accrued pension rights.

Mr McCann said Mr Deasy wanted the decision of the board to be judicially reviewed on the grounds it had erred in law in holding there had been a breach of discipline and that it had failed to comply with the principles of natural and constitutional justice and fair procedures.
