An action taken by Ms Jane de Valera, wife of convicted solicitor Mr Elio Malocco, against ACCBank was settled at the High Court yesterday. Ms de Valera had sought to set aside a mortgage over their former family home at Wincanton, Westminster Road, Foxrock, Co Dublin.

In May 1991, Mr Malocco was convicted at the Dublin Circuit Court on fraud charges involving sums of money which were given by the now defunct Irish Press group to deal with libel actions. He was released from prison recently.

Yesterday, just before the action opened, Mr Michael Collins SC, for Ms de Valera, told Ms Justice Laffoy the proceedings could be struck out with no order other than that the parties have liberty to apply to the court.
