A house-builder has been told not to interfere with hedgerows or trees on a 12-acre Co Kildare riverside building site until the High Court decides if strict development conditions are being complied with. Mr Justice Finnegan was informed yesterday that a number of hedgerows had already been removed prior to Roseberry Construction Company Ltd having submitted a landscaping scheme acceptable to the county council.

Directing that hedgerows and trees be left intact pending a further court order, he also recommended that no works be carried out which would cause damage to archaeological material on the site alongside the Grand Canal at Mulletine, Rathangan, Co Kildare.

Mr Michael O'Donnell, counsel for Mr Michael Hoey, a local objector to the development, said Roseberry Construction was building 73 houses on the site and his client would be arguing that a number of conditions had been ignored by the developer.

An application seeking to have all development conditions enforced by the High Court will be heard next Monday.
