The developer, Mr Michael Bailey, told the tribunal he did not recollect the purpose of most of the 25 phone conversations he had with Mr Ray Burke between 1994 and 1997.
The tribunal heard that Mr Bailey made 20 phone calls to Mr Burke from his home, mobile and his Bovale Developments Ltd office. Mr Burke made five calls to Mr Bailey in the same period, and is due to appear before the tribunal next Tuesday to give evidence on his recollections of the purpose of the calls.
Counsel for the tribunal, Mr Desmond O'Neill SC, led Mr Bailey through a list of calls between the two men taken from Eircom records, ranging from 18 seconds to 11 minutes and six seconds.
In 1994 there were nine calls, six from Mr Bailey to Mr Burke which lasted a total of eight minutes and 59 seconds, and three from Mr Burke to Mr Bailey, totalling 12 minutes and 39 seconds.
In 1995 there was one call from Mr Bailey to Mr Burke lasting one minute and 25 seconds. In 1996 there were five calls, four from Mr Bailey to Mr Burke, totalling 14 minutes and 22 seconds. Mr Burke's call to Mr Bailey lasted 27 seconds.
In 1997 there were ten calls, nine from Mr Bailey to Mr Burke, totalling 33 minutes and 46 seconds. Mr Burke's call to Mr Bailey lasted 15 seconds.
Regarding a call to Mr Burke on February 24th, 1994, Mr Bailey said he had no idea about its purpose, but it may have been "something about local politics."
A call from Mr Bailey to Mr Burke on June 29th, 1997, was in advance of a meeting between the men on Derby Day. Another three calls were made on October 9th, 1997, two from Mr Bailey to Mr Burke and one from Mr Burke to Mr Bailey. Mr Bailey said they were obviously something to do with the publicity from the tribunal.
Mr Bailey could not recall the purpose of most of the 27 phone conversations between 1993 and 1997 between him and Copsey Murray, Mr Joseph Murphy Jnr, JMSE, which was one of the Murphy companies, and Mr Frank Reynolds of JMSE.
Mr Bailey said he recalled at one time ringing Copsey Murray because the company was trying to get Mr Jim Gogarty to sign accounts. He said Mr Gogarty would start "roaring and shouting" about Mr Copsey and Mr Joseph Murphy, and he believed he may have rang Mr Copsey to tell him that he should try to "sort out" Mr Gogarty and not have him in the state he was in. He said he clearly remembered ringing Mr Copsey at some stage, to make it clear that someone needed to help Mr Gogarty. "I was actually afraid of his (Mr Gogarty's) company. I thought he was going to drop dead at some time," he said. Mr Bailey said Mr Gogarty told him that he would do anything to "bring down the Murphys" and he didn't care who he brought down along with them. This was to make them pay for what they did to him regarding his pension.
