A company director in Dublin has made a settlement of almost €428,600 following a Revenue Commissioners' audit. The settlement, which involved an under-declaration of income tax, was made by Mr Aiden Carville, of 62 Hazel Lawn, Blanchardstown, Dublin 15, and involved a payment of nearly €100,000 more in interest and penalties than the original liability. It included tax of just more than €166,000 and penalties of more than €262,000.

Mr Carville was one of 46 individuals and firms whose settlements in the January to March period exceeded €12,697 for non-payment of tax and VAT, according to this month's edition of Iris Oifigiúil.

In all, more than €3.3 million was paid by individuals or companies between January 1st and March 31st. The list includes six cases arising out of the Revenue's investigation of National Irish Bank (NIB) accounts held in a special off-shore investment savings scheme.

The highest settlement in this category was for €255,142.56. It was made by Mr Patrick Lynch, Main Street, Shercock, Co Cavan, whose business is car sales. He paid €190,460.71 in tax and €64,681.85 in interest and penalties.

The third-biggest settlement in the period was for €203,200. Mr Dermot Fox, a newsagent with an address at Dublin Road, Athlone, Co Westmeath, paid €68,216 in tax and €134,984 in interest and penalties for underdeclaration of income tax and VAT arising from the NIB investigation.

Mr Finian Murray, 37 The Square, Skerries, Co Dublin, a company director, paid €139,940.08 for under-declaration of income tax and capital gains tax, following the Revenue's NIB investigation. It comprised €45,385.51 in tax and €94,554.57 in interest and penalties. Mr Patrick Lenehan, Lisbaun, Kiltoom, Co Roscommon, an egg wholesaler, paid €103,740, of which €40.958 was for a tax liability and €63,142 interest and penalties.

Other NIB investigation settlements include company director Mr Patrick Flynn, Killybegs, Prosperous, Clane, Co Kildare, who paid €53,964 and Mr Charles Staves, 2 Coolroe, Newcourt Rd, Bray, Co Wicklow, also a company director, who paid €53,964.

The fourth-largest overall settlement was made by a company involved in the building business. Melincourt Ltd, with an address at 60 Grange Court, Rathfarnham, Dublin 16, made a settlement for €175,937 for an under-declaration of corporation tax and VAT, of which €96,281 was in tax and €78,937 in interest and penalties.

An employment agency from Jutland Hall, Steamboat Quay, Dock Rd, Limerick, CMS Contract Management Services Ltd, made a settlement of just over €158,600 for under-declaration of corporation tax, while W. & H. McMenamin Ltd, 5 Market Street, Sligo, which is involved in the building business, paid more than €151,000 for under-declaration of VAT, PAYE and relevant contracts tax.

Separately, €400,165 was paid by 339 individuals in fines and penalties imposed by the courts in the January to March period for failure to lodge income tax returns.

Seven companies paid nearly €3,500 in fines and penalties for failing to lodge corporation tax returns, while more than €41,000 was paid out by 17 firms and individuals for failing to lodge P35 returns.
