Two men appeared before Dungarvan District Court today accused of assaulting a man whose body was found in the stairwell of an apartment block last week.
John Hannigan (44) of River House, Clonmel, Co Tipperary and Joseph O’Riordan (38) of Inis Óir, Cashel Road, Clonmel were charged with assaulting Anthony Fallon (46), causing him harm, on January 18th last in Clonmel.
Mr Fallon, a father-of-two, was found dead in the River House apartment block on Clonmel’s New Quay at about 6.45am.
InspPaul Heffernan told the court Mr Hannigan was on bail in relation to a public order matter when the alleged assault on Mr Fallon took place. He had been told to be sober when in public, to observe a curfew and to stay away from gardai “unless a matter of life or death”.
He was in breach of two of those conditions, Insp Heffernan said, opposing a bail application from Mr Hannigan’s solicitor, Eamonn Hayes.
Judge Terence Finn remanded the accused in custody with consent to bail, on his own bond of €1,000 and an independent surety of €6,000.
Solicitor for Joseph O’Riordan, Dermot O’Brien, said he was not applying for bail. Judge Finn remanded Mr O’Riordan in custody.
Both men will appear before a special sitting of Clonmel District Court next Tuesday, January 31st.
Free legal aid was granted in both cases after the court heard the two men were on social welfare.
