A taxi driver who was taken unconscious from his car following a crash near Dublin Airport has been awarded more than £23,000 damages in the Circuit Civil Court. Mr David Brady, of Newtown Cottages, Malahide Road, Dublin, had sued Mr Denis O'Donoghue, of Lower Main Street, Clogheen, Co Tipperary, for £30,000 damages for back injuries arising out of the July 1994, accident.

Mr Brady told his counsel, Mr Senan Allen, that Mr O'Donoghue emerged from a car park on Old Airport Road, Santry, into his path. He was unable to avoid driving into the side of O'Donoghue's car. He had to be taken from his car by ambulance men and spent five days in hospital. He was unable to return to work for eight weeks and for another 12 weeks was working only part time.

Judge Esmonde Smyth said Mr Brady's main injury was to his lower back and, while he may have exaggerated somewhat, he seemed to be an entirely credible witness. He awarded Mr Brady £18,000 general damages, with £3,500 for loss of earnings and £1,817 special damages which included medical costs. Liability had been conceded.
