Supreme Court hears Aga Khan Studs appeal

An appeal by HH The Aga Khan Studs SociΘtΘ Civile against a High Court order made in proceedings issued by Mrs Mary Charlton has come before the Supreme Court.

The proceedings related to an injunction obtained by Mrs Charlton restraining the holding of an inquiry into her conduct as secretary to the former manager of the studs, who resigned following his admission that he had perpetrated a substantial fraud on his employer.

Counsel for Mrs Charlton informed the Supreme Court that his client was withdrawing all her allegations against the Aga Khan's Studs and persons associated with it. The allegations made by Mrs Charlton included sworn allegations.

She further accepted that none of these persons acted in contempt of court. Mrs Charlton also accepted that the High Court order made on February 22nd, 2000 - the subject of the appeal - could not stand and that the appeal must be allowed in full.

Mr Paul Gallagher SC, for HH The Aga Khan Studs, applied for the discharge of the High Court orders under appeal. The Supreme Court allowed the appeal in full.

In a statement yesterday the legal advisers for The Aga Khan Studs said they saw the withdrawal by Mrs Charlton as a full vindication of its position in relation to the proceedings.
