An Bord Pleanála has upheld a decision to refuse planning permission for a toxic waste incinerator in Balbriggan, County Dublin.

The scheme, proposed by Herhof Environmental Limited in association with Treasury Holdings, had sought to construct a waste treatment and recycling facility at Courtlough.

The appeal had been taken by Herhof Environmental Limited and Zero Waste Limited following a decision by Fingal County Council on June 10th 2002 to refuse planning permission for the plant.

An Bord Pleanála said it had turned down the appeal on a number of grounds including the fact that the plant was contrary to proper planning as its location was too far from where the relevant waste was to be collected.

An Bord Pleanála also said the proposed development "would adversely affect the use of a national road, the M1/N1 linking Dublin and Belfast".

An Bord Pleanála said the plant would have contravened the current Fingal Development Plan which had designated the land for "agriculture and rural amenities".

The proposed development would also harm the visual amenities of the area, the Bord said.
