No final decision has been taken by the tribunal on whether it will pursue its appeal against the decision of the Grand Court of the

Cayman Islands preventing it hearing evidence there, according to the tribunal chairman, Mr Justice McCracken. If the appeal in the Caymans was proceeded with, Mr Justice McCracken would make his report to the

Dail in any event.

The next formal sitting of the appeal court in the Cayman Island was set for November and it would be quite wrong for the publication of the report to be delayed pending that hearing, said the chairman.

A short supplementary report, however, could be made subsequently in relation to further information obtained from the appeal, he said.

Depending on the outcome of any such appeal, it might be necessary to recall some witnesses to the tribunal. Mr Justice McCracken said he would welcome any submissions which counsel wanted to make in relation to this matter.
