A MAN has won his appeal against his conviction for the robbery of a post office

A MAN has won his appeal against his conviction for the robbery of a post office. A retrial was ordered in the case of Ian Horgan.

Yesterday, the three-judge Court of Criminal Appeal quashed Mr Horgan’s conviction and directed a retrial.

The court found the conviction was unsafe because a warrant obtained by gardaí to search Mr Horgan’s home following the robbery was not properly validated and breached his constitutional rights.

Mr Horgan (25), The Hermitage, Macroom, was found guilty at Cork Circuit Criminal Court in 2007 of robbing Clondrohid Post Office near Macroom on September 6th, 2005.
