The family of Dr Murray has called for measures to be put in place to ensure that, when a person is arrested by the Garda and suspected of drink-driving, a medical condition is not missed.

Ms Clodagh Murray, Dr Murray's daughter, said: "The family is happy it has been put on public record that our father had no alcohol in his system and was suffering from a stroke when the Garda wrongly arrested him."

Describing his death as "cruel", she said he had been denied medical attention when he needed it, and brought to Carlow Garda station, in the opposite direction to the hospital in Kilkenny.

"We can only imagine the torture which went through his head at this time, and it is the family's deepest wish that this tragedy should not be allowed to happen to anyone else," she said.

"We are disappointed that the coroner did not include a rider to the Garda that a Section 49 case [drink-driving related] should be assessed to ensure that a medical condition is not missed."

The family drew attention to the English and Welsh police guidelines for people in custody, which were handed to the coroner by counsel for the family during the inquest. These provide for a detained person's medical report form, to be completed in relation to a person who met one of six criteria.

These are: if they answered positively to any of the medical history questions outlined; if they otherwise apparently suffered from a physical or mental medical condition; if they suffered from such a condition while in the police station; if they received, or should have received, first aid; if they needed, or requested, a visit from a doctor or ambulance; and if they were drunk or appeared to be drunk and there was sufficient concern that medical assessment was advisable.
