A CHILD with cerebral palsy who brought an action against the North Western Health Board is to be paid Pounds 800,000 in a settlement approved by the High Court yesterday.

Victoria Kilpatrick (11), of Upper Main Street, Letterkenny, Co Donegal, suing through her mother, Ms Dorcas Kilpatrick, brought the action against the health board for alleged negligence and breach of duty.

On December 25th, 1985, Ms Kilpatrick was admitted to Letterkenny General Hospital, and the next day her fourth child, Victoria, was born. It was alleged the health board failed to recognise or pay attention to the presence of rhesus antibodies in Ms Kilpatrick's blood before Victoria's birth.

Mr Harry Whelehan SC, for the child, said her parents planned to move to a house more suitable to their daughter's needs.
