A WOMAN has sued a businessman and a solicitor over failure to complete a €4.5 million sale of a property in west Dublin.

A WOMAN has sued a businessman and a solicitor over failure to complete a €4.5 million sale of a property in west Dublin.

The proceedings by Anne O'Neill, Doon Avenue, North Circular Road, Dublin, against Kenneth O'Reilly, Dunsinea Lane, Scribblestown, Dublin, and Patrick Delaney, a solicitor carrying on business as P Delaney & Co, Parkside House, Castleknock, Dublin, were admitted to the Commercial Court yesterday by Mr Justice Peter Kelly.

The case relates to an alleged contract between the sides of April 2007 for the sale of industrial property at Weaver's Row, Kellystown, Clonsilla.

Ms O'Neill claims the property was sold to the defendants for development purposes for a price of €4.5 million and that, at the time of the sale, the defendants intended to obtain planning permission for commercial retail purposes. No grant of planning permission was made.

Ms O'Neill claims the closing date for the contract was April last and the outstanding sum due to her under the contract is €4.05 million. She wants orders requiring repayment of that amount and is also claiming entitlement to immediate payment from the defendants of a sum of €450,000 to discharge a business equity compensation payment for former tenants of the property.

It is claimed that until recently all contractual correspondence had issued through Mr Delaney's office on behalf of both defendants but that was no longer the case. Despite assurances from Mr Delaney on behalf of both defendants, the monies due remain unpaid, it is claimed.
