The High Court today heard an appeal by a Croatian woman to defer the deportation of her husband and son at least until her own asylum application has been heard.
Ms Biljana Sinik is appealing on humanitarian grounds not to be separated from her husband Miodrag and son.
Mr Justice Smyth heard that when Ms Sinik returned from psychiatric treatment in Norway in June her husband and son had received deportation orders.
Ms Theresa Blake SC, for Ms Sinik, told the High Court that the Sink’s circumstances had changed as a result of Ms Sinik’s mental depression and that it was inhumane to separate the family so soon after Ms Sink’s treatment.
She said that the Office of the Refugee Applications Commissioner had said in a written reply to a letter that there would be "no further consideration" of the Sinik case. Ms Blake said there was a fundamental change in circumstances to the Sinik’s circumstances this reply was unfair.
The court heard that Ms Sinik suffers from post-traumatic stress disorder and depression and had tried to take her own life on more than one occasion.
Mr Sinik is currently in Mountjoy Prison and is due to be deported today.
The case continues tomorrow.
