The trial of two Dublin men who are accused of possessing guns and ammunition was postponed until next year after the Special Criminal Court was told yesterday that an essential witness was ill.

Mr Christopher Magee (50), of Mountainview Court, Summer hill, and Mr Michael Kenny (46), of Moreen Park, Sandyford, were due to go on trial accused of the unlawful possession of two Walther semi-automatic pistols and 30 rounds of ammunition in Summerhill on August 1st, 1997.

Det Chief Supt Dermot Jennings told the court that Assistant Commissioner Kevin Carty had recently undergone surgery and would not be available to give evidence. He was very ill and wished to apologise to the court for not being able to attend.

Prosecuting counsel Mr Shane Murphy told the court that Assistant Commissioner Carty had signed an order extending Mr Magee's detention and his evidence was essential.

Judge Matthew Deery, presiding, put off the trial until May 16th next and remanded the defendants on continuing bail.
