Three couples who moved back onto an official Travellers' halting site after they were evicted by the sheriff, yesterday asked a judge not to renew an eviction order against them.
South Dublin Council is seeking to evict Ms Bridget and Mr Joseph McGinley, Mr Michael and Ms Winifred McGinley and Mr Simon and Ms Tilda Doherty from their caravan bays at Old Castle Park Close, Clondalkin, Dublin.
Dublin District Court was told yesterday that warrants were issued last year for possession of their bays because they were in breach of the licensing agreements under which they were issued with the accommodation. The orders were granted under a procedure known as "good estate management" which allows local authorities to seek evictions without having to give specific reasons.
In August, the sheriff arrived and evicted them and their caravans. But a short time later they moved back.
Mr Kieran Pyne, solicitor for the council, asked the court yesterday to renew the eviction order because under amended District Court rules, it was open to a judge to do this rather than go through the lengthy process again from the beginning.
Mr Michael Finucane, solicitor for the three couples, asked that the case be adjourned to allow his clients consider the legal remedies available to them.Judge Conal Gibbons said he would adjourn the case until February 26th to give both sides the opportunity to examine the legal position.
