A garda who was involved in an investigation relating to Latvian woman Baiba Saulite, who was later shot dead by a gunman outside her Dublin home, has sued the Garda authorities.

Garda Declan Nyhan of Swords Garda station has brought the High Court action over alleged bullying and harassment and alleged failure to pay his salary while he was on sick leave. The claims are denied.

Ms Saulite was shot at her home in Swords in November 2006. Marguerite Bolger SC said Garda Nyhan had earlier become involved in the investigation into the abduction of Ms Saulite’s two children. Ms Saulite’s husband was later sentenced to two years in jail for abducting their two young children and arranging to have them sent to his family in Syria.

When Ms Saulite was murdered, Garda protection was immediately put on Garda Nyhan’s home. He was in extreme fear and concerned for the safety of himself and his family, Ms Bolger said. He later went on sick leave.

Mr Justice Kevin Cross adjourned the case until today and reminded the sides if it ran, it would last three weeks.
