Two of the six men charged last week in connection with a £2 million heroin seizure in Dublin failed yesterday to have their detention declared unlawful after they were released by the High Court on Tuesday and rearrested.

Mr Thomas Mulvey (63), of Liverpool, and Mr John Lynn snr (51), of Glasgow, had been released after the High Court found that a District Court judge who remanded them in custody last Friday had exceeded her jurisdiction and acted contrary to natural justice, because they had not been legally represented.

When they were again arrested at the Four Courts new charges of having heroin for supply and drugs worth more than £10,000 were brought.

Judge David Anderson said the State was entitled to proceed by way of substituted charge. He remanded both men in custody until today.
