Stephen Fennell, a prisoner in Mountjoy Jail, is to attend the funeral of his brother, Mr Kevin Fennell (23), who was shot dead in Tallaght, Co Dublin, on Tuesday, on condition he remain in handcuffs and is escorted by warders.
The High Court was told yesterday that the Garda required assurances from the prison authorities that Fennell would be in custody and in handcuffs.
