Man raped and assaulted former lover, court told

A MAN has gone on trial at the Central Criminal Court charged with raping his former girlfriend after tying up her boyfriend in their home.

The accused, a Polish national, has pleaded not guilty to entering the house as a trespasser while armed with a bladed weapon and a weapon capable of discharging a noxious liquid gas; false imprisonment of both the complainant and her boyfriend; and various sexual offences against the woman including aggravated sexual assault, oral rape, rape and raping her with a vibrator on November 25th, 2007.

He pleaded guilty to assault causing harm to the complainant’s boyfriend on the same date.

Eanna Mulloy SC (with Fergal Foley), prosecuting, said the accused and the complainant separated in August 2007 and a short time later she started to rent a room in the home of a man whom she later became “romantically involved with”.

He said the accused had difficulty accepting “this changed turn in events” and in the days leading up to the alleged incident he contacted the woman a number of times.

On November 24th, the accused called the complainant and informed her that he was going to leave her be and promised there would be “no further scenes”.

Mr Mulloy said that that night the complainant woke up after something hit her head, while her boyfriend had been sprayed with something in his eyes which made it difficult for him to see or breathe.

The complainant got up and turned on the light to find a man, dressed in black and wearing a balaclava, standing at the end of the bed and hitting her boyfriend with an object.

She saw the man’s eyes and recognised him as the accused.

She called out his name and told him to stop.

But he replied: “Now that you have identified me, I am going to have to kill both of you.”

He then put a knife to the man’s throat and tied his arms and legs with rope and duct tape before he slashed him more than 10 times around the upper body.

The accused then brought the complainant to an en-suite bathroom off a second bedroom and made her take a bath to clean off blood that had been coming from her head.

He then told her he was going to have sex with her, and made her perform oral sex on him.

Mr Mulloy said that the complainant would testify that the accused then asked for a condom, got one, told her to lie down on her tummy on a bed and had sex with her.

He then brought her back into the room where her boyfriend was tied up.

He then told the man that if “you want her, you should pay for her”, before he further sexually abused the complainant while insisting that her boyfriend watch.

The accused then told the couple that he did not have much time as he had an alibi lined up.

He threatened to harm the man’s daughter and burn down their house if they contacted gardaí.

The complainant later told gardaí that she could not understand how the accused knew her boyfriend had any children, as they had never met before.

The accused then directed the complainant to clean up the bloodied sheets.

He said he was going to leave but warned her not to turn any lights on in the house for five minutes and not to untie her boyfriend for an hour.

Once the complainant was satisfied that the accused had left the house, she locked the doors and used a knife to cut the ropes off her boyfriend.

The couple then called the Garda.

The trial continues before Mr Justice Peter Charleton and a jury of three women and nine men.
