Kerry has won a court appeal against a Competition Authority decision to block its proposed purchase of Breeo Foods.

The High Court in Dublin made the ruling today.

The Competition Authority had blocked the €165 million acquisition on August 29th saying hat it would “substantially lessen com-petition” in the consumer foods market, in particular in bacon, processed cheese and non-poultry cooked foods.

Kerry’s decision to appeal was the first time a ruling from the authority has been challenged in the courts.

Breeo is the consumer foods division of Reox Holdings which was spun out of the Dairygold Co-operative Society. Its brands include Shaws, Dairygold, Galtee and Mitchelstown.
