Gogarty says Murphy jnr was with him and Bailey at Burke's house

Mr James Gogarty was the only one who gave envelopes to Mr Ray Burke at his house in June 1989 and the only other person present was the developer, Mr Michael Bailey, it was claimed at the tribunal yesterday.

Mr Colm Allen SC, for the Baileys and Bovale, cross-examining Mr Gogarty, gave him what would be Mr Bailey's account of the meeting. Mr Gogarty denied the version.

Mr Allen said Mr Bailey could not be certain of the date they visited Mr Burke's house, but it was certainly in advance of the general election on June 15th, 1989. Mr Gogarty called to Mr Bailey's building site at Carlton Court in Swords between 11 a.m. and noon. He arrived at the site alone driving a red car. "I reject that completely," Mr Gogarty said.

Mr Allen said Mr Thomas Bailey would also say he arrived alone in a red car. "There's a pair of them in it, but I reject it as well," Mr Gogarty replied.

Mr Allen said Mr Bailey would say that Mr Gogarty got into the front of Mr Bailey's car. Mr Gogarty said he could not speak for Mr Bailey. He completely rejected it. Mr Allen said: "Mr Bailey will say that under no circumstances was Mr Murphy jnr in the car." Mr Murphy jnr could speak for himself, Mr Gogarty said.

Mr Allen said the journey w as about a mile. When they arrived, Mr Bailey rang the bell and the door was opened by Mr Burke. Mr Bailey would say he introduced him to Mr Burke as Jim Gogarty, representative of Murphys.

Mr Gogarty said: "He introduced me to Mr Burke all right, there is no doubt about that, and he introduced Mr Murphy jnr."

Mr Allen said Mr Bailey did not even meet Mr Murphy jnr until 1992. Mr Gogarty said that was completely untrue. Mr Allen said they were ushered into a breakfast room on the left-hand side of the house. Mr Gogarty said: "I accept that, with junior."

Mr Allen said: "You opened a folder and passed over two envelopes to Mr Burke." "Oh Jesus, there is two now. He said there was only one," said Mr Gogarty.

Mr Allen said Mr Bailey would say that Mr Gogarty asked Mr Burke how the election was going and Mr Burke said he was so busy covering his own patch that he did not know how things were going nationally.

"My recollection is that most of the conversation was between Bailey and Burke and junior and Burke, and I listened to them and I intervened when I thought it was necessary on behalf of senior," Mr Gogarty said.

Mr Allen said they all shook hands and he wished Mr Burke luck. "And junior shook hands with him," said Mr Gogarty.

Mr Allen said Mr Bailey would say that Mr Gogarty gave two envelopes to Mr Burke. "That's a bloody lie. I had only one envelope and that was the £30,000 in cash and a cheque for £10,000 to cash," Mr Gogarty said.

Mr Allen said Mr Bailey would say there was no discussion about lands. "What the hell were we there for?" asked Mr Gogarty.

Mr Allen said Mr Bailey drove back to Carlton Court and there was no conversation of any kind about Mr George Redmond. Mr Gogarty said they did not go back to Carlton Court.
