Journalist Sam Smyth has been awarded legal costs in the tens of thousands against Michael Lowry following his successful defence of a defamation action against him by the Co Tipperary TD.
Judge Margaret Heneghan told Eoin McCullough SC, for Mr Smyth, that he was entitled to his costs.
She refused a stay on her order pending an appeal of all issues to the High Court, which is for mention on October 10th.
Last January the judge refused Mr Lowry a declaration that he had been defamed by Mr Smyth on TV3's Tonight with Vincent Browneshow and in an Irish Independent article.
