Three members of a southeast Clare family have convictions relating to a 33-year-old right of way dispute with neighbours, a court has been told.

In the High Court sitting in Ennis yesterday, Pat Whyms, for Michael Crowe, said three of his neighbours – Noel and Bridget Broggy and their son, Matthew – had convictions arising from the long-running dispute.

Matthew Broggy was convicted of assault while his parents were convicted of stealing trees from Mr Crowe.

All three deny the claims made against them and have appealed the convictions with the appeals to be dealt with after the conclusion of the High Court case.

Noel Broggy, Derrymore, Meelick, is appealing a 2004 Circuit Court ruling that he had no right of way in the disputed strip of land that separated his property from Mr Crowe’s at Knockroe, Meelick.

Mr Justice Michael Hanna said yesterday that efforts to settle the case outside court had failed. Judgment is expected later this year.
