The Special Criminal Court turned down an application yesterday by lawyers for Mr John Gilligan, who is alleged to have been behind the murder of journalist Veronica Guerin, for access to documents relating to his arrest in, and extradition from, the UK.

Mr Justice O'Donovan, presiding, said the application was "a fishing expedition" and that Mr Gilligan could have made it many months ago.

Mr Michael O'Higgins SC, for Mr Gilligan, had applied for disclosure of all documentation on Mr Gilligan's arrest in the UK, on the basis that there might be evidence of improper collusion between the gardai and the English police.

After the court's ruling, Mr O'Higgins said he will make an application before the trial opens next Monday on the basis that the court has no jurisdiction to try Mr Gilligan.

Mr Gilligan was extradited from Britain in February after a 3 1/2-year legal battle to prevent his return to Ireland to face murder and other charges.

Mr Gilligan, aged 48, is charged with murdering crime reporter Veronica Guerin (37) at Naas Road, Dublin on June 26th, 1996, and with drugs and firearms offences.

He was remanded in custody.
