A woman who sued an architect over a failed planning application was told yesterday that she should consider taking her case to a higher court.

Judge Michael O'Leary said any award he could make in the Dublin Small Claims Court to Ms Carol Murray against Mr David Grant would not be enough after he was told she was €3,065 out of pocket.

The court heard she had been refused permission to build a three-bed house beside her parents' home in Glasnevin because the application did not comply with rules on private open space within the property.

Mr Grant, of Haddington Road, Ballsbridge, later suggested putting in an application for a one-bed house and build an extension on to it as this would not require planning permission.

Ms Murray told the court she contacted Mr Grant after she saw his advertisement inviting people with large side gardens to capitalise on their asset. He described his practice as a fully insured architects firm.

Judge O'Leary adjourned the case to March 31st to allow her get legal advice about her options because if he made the maximum small claims award, which he was prepared to do, that would have to be the end of any action.
