Leeds striker Alan Smith is to avoid prosecution relating to a bottle-throwing incident during the Carling Cup clash against Manchester United on October 28th.
Smith was seen picking up a plastic bottle which had landed on the Elland Road pitch and hurling it back into the crowd, where it coincidentally hit the sister of one of his best friends.
Although no complaint was made against Smith by the girl or her family, the matter was still pursued by West Yorkshire Police who on Friday arrested and questioned the 23-year-old.
Smith's arrest caused a furore because it came hours after he had been selected for the England squad to face Denmark in a friendly international at Old Trafford on Sunday.
Smith was immediately dropped from the squad once the Football Association learned of his arrest, in line with policy not to select players for the national team who are under police investigation.
The FA came under fire from all quarters following their decision. However, the Crown Prosecution Service has advised West Yorkshire Police not to charge Smith with any criminal offence.
Chief Crown Prosecutor for CPS West Yorkshire, Neil Franklin said: "Area lawyers decided there was insufficient evidence to prove a realistic prospect of securing a conviction in respect of any potential Public Order Act or assault charges."
