A Dublin property investment adviser failed to return a couple's £10,000 deposit on a number of apartments in Belfast, a court has heard.

Mr John Lennon, of Belton Park Gardens, Donnycarney, Dublin, told Circuit Court President Mr Justice Esmond Smyth that he and his wife, Anne, gave the money to Mr Vincent O'Donoghue, of Red mill, North Brunswick Street, Smithfield, Dublin.

Last November Mr Lennon gave Mr O'Donoghue a cheque for £10,000 as a deposit for an apartment which was fully refundable if the deal did not go through.

Mr Lennon told Mr O'Donoghue they did not wish to proceed and in January sought a refund.

Mr O'Donoghue "failed, refused or neglected" to pay back the £10,000. Mr Justice Smyth granted judgment for £10,000 with interest and costs in favour of the Lennons against Mr O'Donoghue, who had not contested their application.
