AN application by Quinn Public Houses Ltd, stated to have bought the leisure complex at the former Iveagh Baths, Dublin, against the examiner appointed over the company which developed it, was adjourned by the High Court yesterday until Friday.

Dublin accountant, Mr Jason Sheehy was appointed by the President of the High Court, Mr Justice Costello, as examiner to Colmant Ltd on February 14th. The court had rejected objections to the appointment made on behalf of the receiver to Colmant, Mr Barry Forrest.

It had been claimed on behalf of the receiver at the February hearing that Quinn Public houses had paid over a sum of £700,000 to the receiver for the purchase of the assets of the fitness centre.

Mr Peter Kelly SC, for Quinn Public Houses, said his clients claimed to have a binding agreement and was applying to be allowed to issue proceedings seeking specific performance of that agreement. Mr Justice Costello asked if this had been an oral agreement. He would like Mr Kelly's clients to swear specific details of the agreement where it took place why it was not in writing when was the closing date and who were the parties.
