A DUBLIN stockbroker was ordered by the President of the High Court, Mr Justice Costello, to pay £108,456 and interest in damages to the Irish Stock Exchange. The stockbroker is Mr David H. McKenna with an address at Dromartin Mews, Lower Kilmacud Road, Dublin.

Yesterday's decision arose out of a case taken by Ms Clare Benson, of Clonmethan Glebe, Oldtown, Co Dublin who got a High Court order in 1994 that she recover from Mr McKenna, "such damages as shall be assessed by the court".

Ms Benson had sought damages for alleged breach of contract, negligence and breach of duty in relation to share transactions by Mr McKenna on behalf of her late husband, Mr Ralph Arthur French Benson, who died on September 7th, 1993.

Ms Benson, in August 1995, assigned the benefit of that High Court judgment to the Irish Stock Exchange after the exchange, through its compensation fund, paid Ms Benson £48,000.

At the last court hearing, Mr Justice Costello was told the exchange was in effect pursuing the action for the recovery of damages against Mr McKenna. It was agreed that should the exchange recover an amount in excess of £48,000 from Mr McKenna, then it would pay the excess to Ms Benson.
